Conversely (the "Platform") is a multi-channel business communications SaaS platform operated by American Voice and Data, LLC ("American Voice and Data," "we," "us," or "our"), doing business as Conversely. The Platform enables business clients ("Clients") to send and receive messages with their customers and contacts via WhatsApp, SMS/MMS, Live Chat, Facebook Messenger, Instagram, and other supported channels, and to automate communications using chatbots and workflow tools.
This Privacy Policy describes how we collect, use, disclose, and protect information in connection with the Platform, including through the WhatsApp Business API via Meta's Cloud API, the Conversely web portal, mobile applications, and related services.
By accessing or using the Platform, you agree to the terms of this Privacy Policy and our Terms of Use, available at https://www.conversely.net/termsofuse.
This Privacy Policy describes how we collect, use, disclose, and protect information in connection with the Platform, including through the WhatsApp Business API via Meta's Cloud API, the Conversely web portal, mobile applications, and related services.

2. Who This Policy Covers
This Privacy Policy applies to:• Business Clients: companies and organizations that subscribe to Conversely and use the Platform to communicate with their contacts;• End Users: individuals who receive or send messages through the Platform at the direction of a Client (e.g., a Client's customers, drivers, or contacts); and• Website Visitors: individuals who visit www.conversely.net or related web properties.If you are an End User, your primary relationship is with the Client who initiated contact with you. Please contact that Client directly with questions about how they use your information.
3. Information We Collect
3.1 Information Provided by ClientsWhen a Client subscribes to the Platform or uses it to communicate, we collect:• Account and billing information: company name, contact name, email address, phone number, and payment information (processed by our third-party payment processor; we do not store credit card numbers);• Contact data uploaded or synced by the Client: names, phone numbers, and related attributes of the Client's customers or contacts;• WhatsApp Business Account (WABA) credentials and phone number IDs, obtained through Meta's Embedded Signup process; and• Message content and attachments sent or received through the Platform.
3.2 Information from End Users When an End User interacts with a Client's messaging bot or channel through the Platform, we may collect: •Phone number and messaging platform identifier (e.g., WhatsApp phone number); •Message content and any media shared during the conversation; • Structured data entered through interactive flows (e.g., trip requests, delivery reports, form responses); and• Delivery receipts and read status as provided by the messaging platform.
3.3 Automatically Collected Information When you visit our website or use our web portal, we automatically collect:• IP address and general location derived from IP; • Browser type, operating system, and device information; • Usage data such as pages visited, features used, and session duration; and Cookies and similar tracking technologies (see Section 8).
4. How We Use Information
We use the information we collect to:
• Provide, operate, and maintain the Platform and all its features;
• Process and route messages between Clients and their End Users across supported channels including WhatsApp, SMS, and Live Chat;
• Enable WhatsApp Business API functionality, including message delivery, template management, and interactive flows, using Meta's Cloud API;
• Manage Client accounts, billing, and technical support;
• Send account-related notifications, service updates, and security alerts;
• Generate analytics and reports for Clients about their messaging activity;
• Comply with legal obligations and enforce our Terms of Use; and
• Improve and develop new features for the Platform based on aggregate, de-identified usage patterns.
We do not sell, rent, or trade your personal information to third parties for their own marketing purposes.

We do not sell, rent, or trade your personal information to third parties for their own marketing purposes.
5. WhatsApp and Meta Cloud API
Conversely operates as a Meta Tech Provider and uses Meta's WhatsApp Business Cloud API to deliver WhatsApp messaging capabilities to its Clients. Through this integration:
• Client WhatsApp Business Accounts (WABAs) are connected to the Platform via Meta's Embedded Signup process;
• Messages sent and received via WhatsApp are transmitted through Meta's infrastructure and are subject to Meta's Privacy Policy in addition to this Policy;
• Each Client's WABA credentials and phone number identifiers are stored securely and used solely to operate that Client's messaging services; and
• Conversely receives webhook notifications from Meta containing message payloads, delivery status updates, and account event data.
End Users who communicate with a Client over WhatsApp should also review Meta's Privacy Policy at https://www.whatsapp.com/legal/privacy-policy.

6. Information Sharing and Disclosure
We share information only in the following circumstances:
• Service Providers: We share information with vetted third-party vendors who help us operate the Platform, including cloud database providers, messaging infrastructure providers, background job processors, file storage services, and email delivery services. These providers are contractually required to handle information in accordance with this Policy.
• Clients: End User message data is visible to the Client whose channel the End User interacted with. Clients are responsible for their own data handling practices with respect to their End Users.
• Meta / WhatsApp: Message data processed through the WhatsApp Cloud API is transmitted to and from Meta's servers per Meta's platform terms.
• Legal Requirements: We may disclose information if required to do so by law, court order, or governmental authority, or where necessary to protect the rights, property, or safety of American Voice and Data, its Clients, End Users, or the public.
• Business Transfers: In the event of a merger, acquisition, or sale of substantially all assets, personal information may be transferred as part of that transaction. We will notify affected parties prior to any such transfer.

We retain Client account information for as long as the account is active and for a reasonable period thereafter to comply with our legal and contractual obligations.
Message content and session data are retained in accordance with the Client's subscription plan and applicable law. Clients may request deletion of their data by contacting us at the information below.
End User data is retained only as long as necessary to provide the services requested by the Client. Upon a Client's request or account termination, we will delete or anonymize associated End User data within a commercially reasonable time, subject to legal retention obligations.
Message content and session data are retained in accordance with the Client's subscription plan and applicable law. Clients may request deletion of their data by contacting us at the information below.

10. Your Rights and Choices
Depending on your jurisdiction, you may have the right to:
• Access the personal information we hold about you;
• Request correction of inaccurate information;
• Request deletion of your personal information, subject to legal retention obligations;
• Opt out of marketing communications; and
• Lodge a complaint with a supervisory authority.

Upon receipt of an opt-out request, the End User will be removed from that Client's list and will not receive further messages unless they re-subscribe.

11. Children's Privacy
The Platform is intended for use by business users and is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that we have collected such information, we will delete it promptly.
12. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be communicated to active Clients via email or through the Platform at least thirty (30) days before taking effect. Continued use of the Platform following notice of changes constitutes acceptance of the updated Policy.The most current version of this Policy will always be available at https://www.conversely.net/privacy.
